If I jailbreak my iPod Touch with the unthether, will Apple catch me because they made jailbreaking illegal? Doe's it only apply to the iPhone? Help me understand this.

It's not illegal, Apple cannot make anything, "illegal".
Apple cannot catch you unless you go around shouting "OMFG I R JUST JAILBROKEH!".
Any if it was to become illegal (highly unlikely) then it would be for the iPhone and iPod.

So, I'm breaking the contract I made with Apple, but not the law?

I signed nothing when I paid cash for my ipod touch. I can do whatever I want with it and apple can't do a god damn thing about it.

Essentially giving them money to use their hardware and software you are agreeing to their terms, i.e a contract.
Nobody gives a sh*t about their terms but just thought you whould like to know that you are wrong
