k..what do you think the chances are? cause when i brought an ipod touch as new it had 3.1.2 but that was because it was coming from not a popular seller.

but what if its coming from warehouses and such?

When did he put the iPod up? Before or after 3.1.3 came out?

The 3G 64GB was released in September, so no, not a year ago.

However, it shouldn't matter to you. You seem like a first time iPod touch owner, so jailbreaking shouldn't be your first priority. What should be is learning the device/ getting some good apps for it.

After you've gotten comfortable with your device (and your knowledge of it) then you should jailbreak. I've had an iPod touch since September of '07 (before I joined here) and I only jailbroke mine for everyday use in the 1.1.x firmware days.

Anymore, the best reasons to jailbreak are comparatively small (SBSettings, Backgrounder, and themes being the biggest reasons).

Just go for a device; there will be a jailbreak out soon enough anyways, if you listen to the Dev Teams' plans.

Not trying to contradict you but I thought that was a funny post
Because I jailbroke my iPod the day after I got it

If you don't want to take the risk then look up Craigslist.org for iPod Touchs.
