My ipod is close to his birthday and i want to use his warranty, like "the battery Run out of power too fast" and is true. I heard if the ipod have battery problems apple gives to you a new ipod.
My question is, i need to un-jailbreak it? Make a roll back to a past version? Or apple dont care about jailbreak?

apple cares about jailbreak. they will not replace your device if u send it jailbroken...
before you give it to apple just restore the device(ofcourse dont do this at the apple store. do it at home) and give it to them. this way they have no idea if you jailbroke it or not!

Mmm great, but if i restore it to 3.0 i think is ilegal too, because i downloaded it from an X web page, no from itunes. I need to restore it to 2.1?

Just put it in DFU Mode, then click Restore.

Then youll legally download 3.0 firmware for free.

yep, DFU+restore and apple will never know. they do care about jailbroken devices. and you might want to sell the new ipod touch and get a 3g in two months. or you can use it, just use a case and keep it in perfect condition

Yeah coz you got your iPod already on 2.x so you have already paid for the firmware. If you restore, you'll download 2.2.1 for free

Apple gives you the 3.0 firmware through iTunes for free now (since you are already on 3.0). No need to download it from somewhere else.
