i've been having trouble with the ipod safari and a few other menu stuff and i tried restoring and want to give it back but there is a problem with the sound, headphones, menu speeds

i live in canada and i bought my ipod from a target in the us
there arent any target's here would i be able to give it to any store and say
here u go now i want my ipod replaced with a new one
would it work or should i go on apple's site and do it

i really dont want to do it from apple's site cause if they are somehow able to fix it i still dont want it
i just want to get it replaced for the sake of it cause if it happened once it can happen again
this hapened after i upgraded to 3.1.3
i had to because i pressed reboot on boss app accidently with blackrain installed
    and just restored
    so will this be ok

i have a 32 GB 3g 3.1.3 so it really doesnt matter if i get a new one with 3.1.3

    thnx

No. Never. DFU restore it, or give it to Apple.

Why would they give you a new iPod? You didn't buy it from them, they don't have to give it to you...
Just give it to Apple. And honestly, don't be so selfish. If you get it fixed, your problems gone. If you get a new one, lucky you.

DFU restore is always your first and best choice.
