There was an update for skype today. I open it after it installed and I this pop up.
Warning this version only works on unmodifed firmwares 3.0.x and 3.1.x.
How would skype know I am jailbroken?

The popup says Skype is not "supported". That doesn't mean it won't work. I'm not a heavy Skype user (from my iPhone at least), but I'm pretty sure that's just a disclaimer, should there be any problems.

Apple doesn't supply any means of jailbreak detection in their API, but it's easy for devs to check this anyway.

Actually, it only does it on jailbroken devices mine did the same thing. I'm not sure how they got the detection in there though :/ Anyway don't worry about it you'll be okay.

That's what I meant, my phone is jailbroken.

There are many ways for devs to check if a user is jailbroken, one being to see if anything exists in/at /private/var/lib/apt/. Performing such a check is one line of code.
