    Now that's an idea!

So am I totally up the creek or has anyone really been successful in downgrading their firmware?

You can only downgrade their 8GB models from what I've heard. I've downgraded a few of my friend's iPods using the 2G iPod firmware (3.1.2) and all works well but it seems that Apple has done something about this (since I can't downgrade my friend's newly bought iPod). Try downgrading using the 2G 3.1.2 firmware, no guarantees but worth a shot.

I don't understand why you're complaining. You're acting as if your iPod is completely useless because you can't jailbreak it. Use it the way it was supposed to be used. Music, videos, photos, games, apps etc.

Wow, it sounds like your getting mad for getting an ipod. lol. Just be happy they even gave you a replacement. Unless you want to spend another $200 to get a new one, just to get it jailbroken, use it how it was made to be used.
