I have a 64 gig 3g ipod touch and the lock and volume buttons just stopped working, I was going to take it to the apple store to get it repaired because its under warranty but I was wondering if they would update it to 3.1.3 making it unjailbreakable in the process of troubleshooting or if they would just give me a new one, and if they gave me a new one would it have the update?

I would try restoring your iPod first. My lock button was malfunctioning so I restored and it worked like new.

Just say that it doesn't work with iHome or something when u upgrade to 3.1.3 so they won't do it. Also, I bet they just give you a new one anyway
