I'm currently using a jailbroken Ipod touch 3G (used blackra1n)

but i just wanna upgrade to 3.1.3 and jailbreak it using Sirit (since its untethered).

If i do this, do all of my winterboard themes and other programs that were only allowed in jailbroken ipods get deleted?

if so, is there a way to re-jailbreak with Spirit wihout any data loss?

I could be wrong but I think there is an app backup you can get through jailbreaking.
You can also save your apps/themes via SSHing

Okay. So you cannot jailbreak an iDevice using the Spirit jailbreak if you are already on a tethered jailbreak. It simply will not work. You have to restore your iDevice. The only time you don't have to restore while using the Spirit jailbreak is if you are NOT already on any kind of jailbreak. So just backup your stuff and write down any packages and sources from Cydia that you want to redownload later and restore. Then you can rejailbreak and it will work.

    1. SSH and navigate to /private/var/stash/Themes
    Backup.

    2. Write down the programs and apps you want to still have after, i wouldnt try SSHing them because they install things allover the place =] (if they're app store apps then just back them up on iTunes).

To SSH you need to download OpenSSH and a client for your computer (cyberduck for mac =])
