    Okay here's my story...
2 weeks ago I won an iPod Touch 3rd gen and wanted to jailbreak. But Geohot hadn't released one that worked with mine, so I traded it to some kid for his 2g. His is kind've scratched up, and mine was pretty brand new (You don't have to tell me how stupid this was, I already know). Is it possible I could replace it without a warranty? I'm willing to pay under $100, but I won't be surprised if I'm screwed.

Well there is nothing actually wrong with your ipod..
thing you can do is.. sell the 2g and use the money to buy a 3g (of course youll need to throw in some money)

Hahaha, that can be possible... But better check the warranty on your traded-in iPod first, before doing such a risky thing!

But what made you swap your new touch with a slightly older one?

I think it will, the warranty is not under his name, it's under the ipod's serial number.
