Force reboot it, and if it is still frozen, put it in recovery mode and restore it.

    YOU GUYS ARE DUMB..

He said he cannot use the home button!
Therefore he cannot hold it for longer then 5 seconds to exit a app correctly.
He can neither force reboot because the home button doesn't work!

LOOK HERE I HAD SAME PROBLEM: http://www.ifans.com/forums/showthread.php?t=51269

Anyways the best thing to do is restore to 1.1.4/5..
CAll apple and explain your problem [ THIS DOES AND WILL HELP ]
If none of there guides/troubleshooting doesn't work they will set something up.
It will most likely be a shipment for a new/refurbed ipod..
Or they will make you go to a local Apple store and have them check it out..
There they will give you a fixed/refrubed/new ipod touch.

Tell Apple that you belive your iPod is defected.
If you bought your ipod within the last 11 months its still under factory warranty.
So you will get this replaced fore FREE.
Only thing you have to pay for is driving to Apple store.
If your not driving they pay for the 48 hours service and shipment crap.

depending on the apple store they might not replace it for him. They can say that the big dent on the back is damage done by the user and has caused the defective ipod, so hopefully he gets some people that arent asses.

ps: everyone bought their ipod within the last 11 months as they only were releases 10 months ago.

If it's under warrenty, I'd get it replaced.

definitely try to have apple fix it. the only problem is that the big dent in the back might lead them to believe it was due to mishandling, which isn't covered by the warrenty
