ive updated my ipod from 3.1.3 to OS4, and backed up.

after warranty, the new one has a 3.1.3 default and i want to use spirit to jailbreak as it is a MC model. if i jailbreak:

can i use my last back up?
how do i prevent it from auto update to os4?
after my jailbreak will i still have my notes and contacts etc.?
i heard that i cant let the battery run flat after a jailbreak if not i gotta rejailbreak, so can i still restart or switch off my ipod without losing the jailbreak?

    PLEASE HELLPP!!

    thanks

i plugged it in after installing the OS4 a few days ago. itunes auto backed it up for me, so will the ' backed up OS 4' be able to run the spirit jailbreak which is for OS 3.1.3? its a new ipod which means when i plug it to itunes it asks me if i want to restore from last ipod. if i restore from last back up does it auto update to OS4?

    sorry i sound confusing.

No, you can't jailbreak by using a backed up file. You need a backed up 3.1.2 shsh file (impossible to get now). Or you'll have to wait for the 4.0 jailbreak.
