The simple answer is HELL NO don't upgrade to 3.1.3 for any reason - it doesn't do anything except fix a battery gauge issue on an iPhone 3GS and it also mucks up Jailbreaks on most everything else.

If you have a 3rg gen iPod touch 32GB model and it's currently at 3.1.2 DON'T UPDATE IT FOR ANY REASON or you'll end up being stuck like the rest of us that either did update (most) or bought one with 3.1.3 on it.

Keep it at 3.1.2, and don't let iTunes bother you with potential updates, forget about it.

Keep it at 3.1.2, at least with that firmware you CAN do a tethered Jailbreak.

    So, don't update... got it?

You can still use it with iTunes without updating it to the 3.1.3 firmware, just tell iTunes NO when it asks if you want to update.

Yeah, is it jailbroken? At first it sounds like no, but then it sounds like yes...

My ipod WAS jailbroken, I wanted to get rid of all that stuff I had and like just have cydia and rock then download just all over again. I pressed
Erase all content and settings in settings and then it went back to the itunes restore thing, I tried to blackra1n it but it got stuck at the screen where his pic comes! I tried like 3 times, didn't work... Any solution?

Look up iRecovery, if you can get it to the dock into the itunes logo it can boot it for you, that's probably your best bet.

i think he means if you get the picture where it has the USB cable and itunes logo showing you need to connect it to itunes, instead you just press blackra1n boot it that way.
