    Since this thing is going to be around for a while, I thought we could all do with a nice, official discussion thread.

    So I made it.

    Anyways, with what I've seen, I don't think there's a question of if Samsung is guilty or not. I think the question is more along the lines of how much Samsung owes Apple...

    Your thoughts?

    Edit: Let it be understood that this thread will be moderated. As in, if you post off-topic, I will delete it, and any posts that are quoting yours. Also, flaming and trolling will result in a ban. If you think it is inevitable where this thread will go, then make the difference and try to steer it in the other direction.

    Well, Samsung clearly is Apple's competitor at this point. Although, the Galaxy SIII is a fantastic device, it's certain it would not exist without Apple. What Samsung owes Apple is the inspiration they received from their releases. Inspiration that allowed then to take it a step further and see that you can make a phone better than a bunch of tiny keys (largely copied from a computer's method of input) no one can properly press.

    In the world of copyright, apparently a thing goes. Samsung blatantly copied Apple and lots of other top companies variod times. The fact that they were allowed to release such unoriginal garbage screams money here, money there.

    Samsung made a hell of a device with the s3 but they clearly copied apple and for that reason they deserve to be sued

    To be honest, I'm not convinced that Samsung is guilty of anything..
    I will say that I think it's clear that Apple definitely sues too much in general.
    I will also remind us that: Apple started it.
    But they are both large companies, not people, so I have no one to blame but the "way of the corporation" and of course humanity.

    Samsung wins in the phone realm while Apple wins in the tablet realm. That's how I see it. In the beginning Samsung definitely copied Apple but now, it's getting ridiculous. Some of the patents Apple has are absolutely insane! But hey, they were granted the patents and they have rights to them.

    The problem on Samsung's part is that they don't have a product(s) who's evolution morphed into something that resembled multiple Apple product(s). That's the proof they have that will set them off the hook. Apple has a long chain of prototypes that support their final base design for their product. Many are pointing and saying no, look at the F700. Although from the front it is like the iPhone. If you flip it to the side, the design is no where near. This wouldn't do Samsung well in court as it doesn't show that Apple took their design. Apple's designs have been used in Samsung products, there is no denying that at this point in time.

    And that, in and of itself, is enough to convict Samsung of being guilty of infringing on Apple's trade dress. I don't think there is any question that Samsung did make products that were intentionally modeled after Apple's iPhone and iPad.

    The patent arguments are more "in the sticks," and are harder to talk about. There's even an argument about whether an software patent is truly valid. That's all well and fine, but Samsung will almost certainly be convicted of infringing on Apple's trade dress, regardless of whether or not the patents are valid.
