Long time lurker, first time poster.
Well, I bought my Ipod touch 16GB 2nd Gen on easter in the NYC apple Store, together with a Nextware clear case, it serverly scratches the back of my ipod and left some smaller scratches on my screen,
seeing as I bought it in an official Apple Store, could I get a new Ipod with my warranty or should I contact Nextware?
    Please help me out!

I don't think either one will help you out. You're out of luck, my friend. You'd probably have more luck with Nextware than Apple.

Thanks for your hyper speed post, I'll probably try my luck with both, seeing as Nextware damages my Ipod Touch and Apple sells a case that clearly is designed ill.

Contacting both couldn't hurt. Just don't get your hopes up.

Edit:Nextware already answered, nothing interesting , but atleast they answered!

    Hello there,

Thanks for your query. It is unfortunate to know that your iPod touch 2G
got scratched. This is the first time we have ever received a query about
    iPod touch 2G getting scratched.

Regarding the case, we wanted to clarify that the plastic case has a gap
of 1mm between the actual case and the iPod surface as the case grips from
sides of iPod touch 2G only. The case never touches the iPod touch 2G
surface at the back. You could also observe the gap if you slide out any
of the two parts and look below. We took scratches into consideration
while designing the case, hence we created a small observable gap to
prevent any back scratches. The scratches can only appear if the case is
improperly slided on iPod touch surface. We do expect user discretion
while putting on any type of case. This is something that would not come
under warranty as warranty covers the case only.

Rest assured we do take customer queries quite seriously and do continue
to continuously work towards improving our products.

    Have a Good Day!

    Thanks,
    Customer Service
