New iPod - Dead battery?!

    Hi,
    I bought my iPoT 2days ago. On the first night, I left it to charge with an official apple charger. It didn't charge. It shows the screen but doesn't charge.
    So all day yesterday left it on my mac - same thing.

    Is it a faulty battery? Are there any tests I can do?
    Here's what it always looks like:

    EDIT: Oh and if i have to take it back, I'm screwed aren't I? (Jailbroken).

    I'd say plug it in and use ziphone or iliberty+ to stick it into DFU mode if possible, then restore and send it back in.

    Thanks Redshift, i'll give it a quick go now and let you know what happens.
    EDIT:
    Unfortunatly, my mac still doesn't recognise it, whilst nothing comes on the touchs' screen, nothing appears in iLiberty+ either.

    Hmm... not sure what to say. Try resetting it freshly (even though it shows dead battery stuff) by holding home and sleep. Then plug it in and let it sit overnight or something, so that by chance you might get just enough charge to restore (DFU mode preferably) it so it can safely be sent to apple.

    I Put it into DFU and just kept disconnecting, reconnecting etc...

    Wahey, iTunes is now restoring the iPod

    I would suggest you take it back. My battery was screwed, but now finally (kinda) getting better. But now, due to serious lag, I'm going to restore and maybe return it

    thats pretty annoying, new ipod and then unusable! i hope ur gonna get it fixed!!!

    After it has re-updated it's gone back to the battery problem. Guess i'll be making a trip out.

    Damn, I just phoned up and they don't have any in for another week - this sucks!

    I might just go in, because when I bought it they 'didn't have any in', I said I don't care about the firmware version, as long as I get a 16gb iPod Touch and he came back with one (1.1.1) so i might try it again today, shame though, it's a long journey
