OK guys recently sold my Ipod touch 4g to fund my iphone4. I've had it about a week now and it's been a breeze to use but I've been having a few problems recently.

So straight to the problems. It randomly shuts itself off, I've tried DFU mode, Restart and restore. But it seems to still restart.

    It's running 4.1 and it's not jailbroken. Thanks ?

That sounds like a unique problem, mine is pretty much fine. Your best option is to turn it in and get a new one.

I know this sounds stupid but what would happen if I did jailbreak my phone ? could this counter the random restart problem ?

Don't jailbreak it though if you plan on returning it to the Apple store!! They won't give you a new one. That's common sense, but I've seen it happen....

Try jailbreaking it. It could fix it. It's not much of a hassle to do it.
