I have downloaded the firmware but it has to be verified by apple and always fails. IS there a way around this?

See if this works: go to felixbruns.de, or google it and download a 2G 3.1.x firmware(make sure your using a browser other than IE) and once the download is complete, move the firmware to your desktop, plug your iPod into your computer, shift+click restore and select the custom firmware, and wait for it to get through restoring

    hope this helped

The firmware file that you are trying to downgrade to, is it's icon the little Apple box, or a folder (.ipws, or .zip)?

You need to DFU restore it. So put your device into DFU mode (make sure the screen is black, and does not have the connect to iTunes symbol) and simply shift + restore. Here's how to put your device into DFU mode.

Note: If DFU restoring doesn't work, and your iPod is then 'stuck' on the black screen, hold down the sleep/wake button and the home button (at the same time, of course) until the Apple logo appears.
