I was charging my iPod and I recently noticed that it says, "Your iPod software is up to date. iTunes will automatically check for an update again on 1/16/2008. So will I be given an option to not upgrade when it scans again on 1/16/2008?

Of course it will not update without your permission. It will just notify you that an update is available.

It's not illegal for them to automatically update their own stuff.

The iPod touch is not "Their own stuff" when it is sold. The customer has purchased it, it is therefor belonging to the customer. They cannot force the customer to update the device, only inform them that an update is available.

They could however force you to update if you want to continue to use their itunes service.

Yeah they could do that, but they would have to update you're iTunes too, they can't just magically make all of the current versions of iTunes just stop working.

    SIMPLE, Open Itunes and......

    Click EDIT
    Click PREFERENCES
On general Tab, uncheck "Automatically Check For Updates"

Da DAHHHHHH, Itunes or your touch does not know about any available updates.
