so since it's tethered i tried to re-jailbreak it with blackra1n - but it didn't work
i got it into dfu mode (well sorta) i go into itunes to restore and it says "iTunes has detected an iPod in recovery mode. You must restore this iPod before it can be used with iTunes" i press OK and then the iPod disappears from iTunes.

So now its stuck at the iTunes logo with the USB
    Has anyone else had this??
Please help me! thanks in advance!

Try another computer. Or try blackra1n again.

s'not possible to brick it because DFU is on a hardware level, I think... But as for your problem, take it to apple. If it isn't possible to fix it, they won't even bother to try. They will just give you a new one. Good Luck and Merry Christmas.

Tell us what happens. This is the main reason that I won't JB my iPod when I get it. Just not worth it, even if you can get some cool apps and themes....oh well!
