my touch fell in the sink, and the battery is having issues. (i don't think it is related to the sink though, it worked fine after until after 3 COMPLETE charge cycles.) but the water sensor is still white. Can I return it and get a new one?

It's under warranty unless it's jailbroken. Go to your local apple store and see if you can get a replacement.

i highly doubt they will take it back. where is the water sensor? make sure you do a complete restore before going there though. after that dont put any media on it. then whene u return it say u just got it as a present todya and u dropped it in a puddle of water 10 min after u opened it. maby they will have some sympathy

I believe that it is litmus paper, and it changes in response to the slight acidity of water (I might be wrong though).

I doubt Apple would take it back. I think warranty applies only for manufacturing defects.
