So I have a Jail-broken iPod touch, I just noticed recently that the screen moves into the iPod when I press down on the touchscreen.

My warranty is valid, what I want to know is that if I restore it to original firmware (which deletes the jailbreak and all traces) will Apple still be able to find out that I have jail-broken my iPod?: I heard jailbreak voids the warranty but if they don't know I've done it they will still fix it

    Restoring removes the jailbreak completely

So I don't have to do that DFU mode crap, because I don't know much about that, so I restore it to the firmware which was included when I bought it?

Wouldn't Apple be a bit suspicious that I have nothing on my iPod xD

Not really. If they don't see the jailbroken apps on there you'll be fine.
