It may be a hardware defect then

ok so should i take it to an apple store because i got it for christmas so it will still have the warranty right?

plus does having hundreds of scratches on the back of your ipod touch void the warranty.

    thanks

It comes with a 1 year warranty, so you should be okay. No, scratches do not void the warranty.

ok great i have another problem

i tried downgrading it back to 2.2.1 but an error occured

now my ipod is stuck in recovery mode

i have tried everything to put it in dfu mode to restore but the lock buttons not workng so...

plus when i plug it into itunes it doesnt even say its in recovery it just says

the ipod software update server could not be contacted. the server does not support this version of itunes

    but i have 8.2

so will my ipod being stuck in recovery void my warranty??

No, being stuck in recovery mode will not void the warranty
