lol that would be funny if it was in there.
I just read part of the agreement on the iPod touch settings and it said that any distribution copying or modification of this software is granted read it yourself towards the top of the agreement

ts legal as long as you give credit to the original author and tell people its a modification to the 1.1.x firmware
no, actually giving credit to the author is fine, but you have to GET PERMISSION, and not from the author, but from the people who actually own the code and own the copyright to it (apple), and apple is not going to give it to you
