You should've bought the iPod touch 2G so you can have untethered.

Notice: The iPod touch 3G (8GB Model) is no different from the iPod touch 2G models.

It's supposed to have a faster processor, though tests show minimal if any improvement.

The iPod touch 3G (8GB) is not supposed to have a faster processor, that only applies with the 32/64GB. The iPod touch 3G (8GB) is no different from the 2G and that's why it is not worth buying an 8GB iPod touch 3G.

so if the 8gb ipod touch 3g is the same as the 2g can it be non teathered? Only reason is because my bro wants one(got his stolen) and we can't find any 2g for sale.

If you buy and 3G ipod, it will be tethered, not matter the memory.
