I have 2.2 software updated about a week ago, anyway I tried to turn off my ipod after listening to music this morning and it will not turn off. I've tried holding down the on/off button(on top) along with the home button but still nothing. Has anyone else had this problem? what did you do to fix it? Any help is appreciated.

Force shutdown by holding power and home at the same time. It should work...
As soon as the screen goes black - release both or else you'll enter recovery mode.

Then when it's black, hold the top power button to switch your iPod on again.

If it doesn't happen to work... run down the battery by running a graphics-heavy app and then recharge it again and it should function properly...

Yeah I've tried that and still nothing; I'm thinking about returning it.

you might have a broken lock button, if you do and you still have warranty, return it to apple

Anyway... Take it into Apple, I'm sure they'll fix it for you.
    Was it jailbroken?

No it wasn't jailbroken; yeah I think something is probably wrong with the on/off button so I'm going to return it.

if you click the sleep button(not hold it) does the screen turn off? if so its not broken.

That is exactly what it was; the technician at the Apple store said that they see it happen with the phones but not really with the touch's. They replaced it under warranty no problems; great customer service!

If it's not jailbroken, take it to Apple..
Or, try to call them first.
