ipod touch 3.1 question

    I Downloaded the 3.0 ipod software update without paying the $10.
    I was wondering if it will be a problem if I take my ipod touch to best buy to change my battery and possibly my touch screen?
    Will they check if I payed for it or they are more concerned about jail breaking? My ipod touch is still under warranty and its working well, but I noticed my battery life drains faster than the first day I bought it.

    EDIT: I have 3.1 now and its not jail broken.

    1. should have paid
    2.it would be the whole ipod touch not just the parts, yes you can. restore the ipod first
