Ipod touch 1st gen battery replacement

    Hey guys,
    Well after using my 1st gen ipod touch for over two yrs finally i got the "white screen of death". The apple store guy said that my battery needed to be replaced and that i should send it to apple and they'll send me either a refurbished or a new ipod touch.
    I have a few Q's regarding this
    1. I had upgraded to the 2.0 firmware so will the ipod they send me also be upgraded to the same firmware.
    2. Will i be able to load all the apps i had bought for my old ipod onto my new ipod without having to pay for them again.
    3. Since the ipod 1st gen is out of production and so is the 2nd gen, what are the chances that the replacement ipod sent to me will be a 2nd or 3rd gen

    I would never want a second gen unless I could get 64GB. Every one at school thinks the 1st gen is better anyways.
