Are you closing apps via the multi-task bar when your not using them? (Double click home button). Otherwise try a re-store (make sure and back up first)!

Unfortunalty I don't have multitasking cause apple is picky about giving features to people and by crashing I mean closing the app and sending me back to the homescreen

Uh..you probably should just restore your iPod.I restored my iPod when I upgraded to the 4.0 so it would act like new and everything. So try that.

Restore it as a brand new iPod, if possible to 3.1.3, if not, to iOS4.

Do not restore from a backup; instead, manually sync all your itunes content to your iTouch.
