Most likely they are! I mean, there may be a chance that the first person to get the iPhone 4g got it from a random drunk guy who thought it was his. I mean, this is possible, but not likely.

Here we go again, another "leaked" iPhone 4th-gen... Still, there seems to be still some element of surprise since we do not know what the "actual" article will be like, come mid-2010!
This is very unlike apple, to have not one but TWO leaks in such a short period of time... either theyre doing a publicity thing or someones gonna lose their job
Yup... I just think it's for publicity. I don't think they'd let more people have the prototype to leak, if they didn't want it out yet.
Weather its deliberate or not, Apple seem to be doing fantastically out of these "leaks".... Think about it, the previous "leak" got them prime time coverage on most news channels. How much would they have to pay for all of that if they were actually advertising the fact that a new device is imminent? And this current "leak" I'm sure has got plenty of fall out still to come from it. Deliberate or not this is really doing Apple no harm at all at a time when new Android phones seem to be popping out almost daily. Of course if it is deliberate, then I highly expect the new iPhone to look very different from the items featured in the past few weeks.
