iOS 4.0 iPhone 3GS Internet Tethering Question

    In 3.1.3 I was jailbroken and noticed that in Settings/General/Network there is an option for internet tethering. I am somewhat sure that it is illegal to tether AT&T so I never messed with it and thought it was from something I had downloaded from cydia. Now on iOS4 I still see this option. I did use a backup but nothing else is appearing. Why is internet tethering there if it is illegal?

    They are allowing tethering but if you have AT&T you have to pay for it.

    It's an extra $20 a month.

    And you're still limited to the amount of data you pay for.

    You'll have to cancel your unlimited data plan and switch to one of the new ones ($15/mo. for 200MB and $25/mo. for 2GB). Then, you'll have to add an additional $20/mo. to your bill to enable tethering.

    That does not seem like a good idea and a considerably expensive one.
