Headphones i doubt will work, they'll just give you new headphones or make you buy new headphones. It hast to be the jack or something with the ipod touch itself.

And yeah, i live in newyork.

you could also just send a million annoying, nagging emails to apple support complaining about how you have to pay for the app pack, and eventually they'll get tired of you and give them to you for free.

If you have a scratched screen you should go in and say "hey my screen scratched and I don't know how, is there any way to fix it?" Don't just say give me a new one my screen scratched! Make them think you're a n00b and they'll probably feel sympathy for you.

Actually you only need to send 2 nagging, complaining emails. I got them free. ;)

the repair policy for any iPods is that they don't DO repairs! If you have something wrong that was not caused by neglect or damage (like dropping it into a swimming pool or running over it with your car... or possibly even scratching the screen) their 'repair' policy is to hand you a new iPod. I suppose they've discovered that the amount of time/resources it takes to repair most ipods is less than just handing out a new one.

Anyhow... just a little background on how/why that works.
