home button problem

    first time poster....hope this isn't a repeat topic.
    ipod touch 32gb, 3rd gen, 3.1.2 (7D11)

    my home button seems to be intermittent. from sleep i have to press it sometimes 2 or 3 times to wake it up (sometimes only once). when running an app and i press the home button to exit, it sometimes goes right to my music song list even though i'm not playing music instead of going to a home screen. from a homescreen, sometimes i'll press it once and it will bring up the music controls as if i've double clicked it.
    anyone think this is a software issue? i did a software reset and restored my ipod from a back up. did this reload the same bad software? or is this a hardware issue and i should use my protection plan to get it worked on?

    If you are having problems and are still under warranty take it to the apple store or call them up.

    that is a hardware issue
    there is probably a bad connection with the button contact allowing it to think you never clicked or let go and clicked again when you only clicked once etc.
