Is there a way to bypass the apple check and upgrade to the 4.0 software or some other way to upgrade without iTunes

You don't have to bump your thread 17 minutes after you originally posted. Someone will answer it when they answer it. And no, there isn't a way. You need your UDID registered and Apple needs to contact their server to see if it's registered or not. I couldn't even restore my device to 3.1.3 because they couldn't contact their servers (my internet was disconnected and I was too lazy to reset the modem).

Nope, you need your UDID registered. It's the only way.

Not lame, Apple just doesn't want people pirating their OS betas.

If you restore a beta firmware and don't have UDID registered or if you're not a dev, it will not let you sync it. There is no way around it.

Don't bump your own thread. And read the announcement.
