Woah, suing Wal-Mart for a technical difficulty made by Apple. Well done.
Have you even tried using a different USB port?

I CANNOT RESTORE IT!!! THE IPOD DOESN't EVER GET RECOGNIZED!! FOR 2 SECONDS I CAN BARELY MOVE MY CURSOR OVER TO RESTORE THING BEFORE IT TERMINATES!!

    DFU mode + restore.

    If nothing works, contact Apple.
You're not going to sue Wal Mart, you'd simply be laughed at for not using the manufacturers warranty.
