First of all my power button is lodged inside the ipod unit. I can press relatively hard to make my ipod go to sleep, but it isn't like what it used to be. When you can hear a click.

My other problem is that my volume keeps lowering itself. I checked my volume controls on the side and nothing is interfering with them.

And one more question is it free of charge to send it to Apple to get it replaced? even if it's jailbroken or do I have to revert to the original firmwire?

I can post a picture of the power button if necessary, thanks!

Try a restore first to see if it fixes the volume buttons.

Always 100% definitely DFU restore to the normal firmware before sending to Apple.
Check if the Water Indicator is triggered as well.

I wonder if Apple will say that the Power Button is like that because of incorrect usage or just replace it. I would like to see pictures, maybe it could be retrieved if you open it? lol.

You could download SBSettings and you won't have to use the power button.
