I've had my touch for about 10 months now, and I noticed the battery life was getting pretty bad, I can't even get through 1 hour of Safari on a full charge.

I went to Apple's Accurately Determine your Ipod Battery Life page here:

    http://support.apple.com/kb/HT1322

With factory settings, wifi off , screen off, I get like 11 hours of music playback.

Is this like bad enough for apple to replace it? ( still under warranty )

    Thanks

You should just go and get it replaced.
If it's still under warranty, and one little problem happens, send it in.
It's better getting a new one.

You never know you may end up surprised getting a better model, for example, I sent in my 16GB because of audio problems, and then I ended up getting a 32GB returned to me.

If you can go to an apple store and show them your battery life with Safari and explain your story, you're good to go for a new iPod.
