I want to place the untethered jailbreak on my iPod, but first I need to restore it to it's factory condition. I click restore in the device window and it downloads the firmware and when it goes to install it there is an error.

You do not have to restore your iPod to factory settings if you want to jailbreak it. Try going through the jailbreaking process, then tell us if the messages keep popping up.
