My audio jack recently stopped working and it's still under warranty. I have it jailbroken and I love being able to customize the look of it. Is it possible for me to restore it, send it to Apple, and jailbreak it after I receive it? Or will they update it so I can't? Or will they just send a new one with 4.0 on it already?

Um, just DFU restore to get rid of it. They might fix it and send it right back to you. If not they will send you a refurb I think. Not sure what firmware it will be though.

I believe the refurbs are 3.1.3, while iPods being fixed, will be tested via USB and such, and updated while they're at it..
