a new contract, than cancel the contract in a day, pay the early termination fee, and keep the iphone 4?

you can but it'd probably be cheaper to get it on prepay

How do I get it on prepay, I thought you are forced to create a two year contract to get a new iphone?

from what i hear (im in australia), all iphones in the us are locked to at&t? so even after your plan finishes its eternally locked to at&t. even if you could buy a plan then cancel it and pay out all the fees etc, it'd probably be cheaper to just import it from a country that has unlocked ones (hong kong, france, uk and australia come to mind).

Im not sure how much the ETF for at&t is, but i assume that as well as the ETF you would have to pay for the handset repayment? or if its subsidised then the cost of the plan x remaining length of the plan?

I just chose the cheapest costs on at&t website and...$199 for iphone + 15/m (data pack) + $39.99 p/m (nation 450) and no messaging pack. I think that an iphone is locked to at&t plan for 2 yrs so the total is $1518 (i'm probably wrong somewhere here with the figures and my lack of understanding of at&t plans). Now factor in the ETF.

Assuming the iphone 4 is about $1100 aud = $928.2348 USD by todays rate. Then add freight, and tax into US, i think your looking at around $1000 - 1100 USD.

so it looks like it's cheaper if you buy it from australia.
however if im completely wrong above and the $199 for when you buy the iphone is the handset cost, then you probably wont need to pay the the plan costs.

this is just my opinion but:
UNLOCKED iphone from australia = about $1000 USD
    iphone eternally locked to at&t = $$$$$$$$$$$$$$$$$$$$$
