It's definitely broken, very stiff when you press down on it and it doesn't work.

I've checked tech support and the warranty appears that it's still valid

I'm hardly ever home so calling me isn't an option.

What can I do to resolve this issue.

Does the warranty support hardware defects?

    Thanks

EDIT: Is there a virtual home button in the mean time?

Yes, it's definitely covered. Mine is also broken, and I'll be getting it replaced soon.
As long as it's not water damage, you should be good. Just take it in to an Apple store and they should replace it.

Unfortunately, there's no app to replace the home button's function. Unless your iPod is already jailbroken, there's not much you can do. If it is jailbroken, I think there might be a workaround, but I'm not positive.

    However,
Doesn't matter if you call or go to the store.
You MUST pay the $39.99 fee for shipping etc. after 6 months.
So you know what I did?
I went on ebay and spent $20 on applecare warranty which means I didn't have to pay the $40 shipping AND i got my warranty extended to another year!

    try it.
ask me if you need help.

Not true. They do not charge a fee (at least where I live in the US) for bringing in iPods to the Apple store to be diagnosed, whether they have 11 months or 1 month left. I got my old iPod replaced when it had 2 months of warranty left. If it's still under warranty, they won't charge you if it's covered, whether it has Applecare or not. I have talked to them and confirmed this.

    What...
I called them before I got applecare.
I had less than a month left and they said I had to pay $40 for shipping and I asked them if I could just take it to the apple store and there like I would probably still have to pay...

    so im confused now

    btw im in toronto canada

Yeah, it might be different in Canada. I just know they wanted to charge me $29 to send it in for shipping, but at the store it's free.

Still, I'd say you did the right thing buying Applecare. Then if you needed to send it in it'd be free.

Yeah because my nearest store is an hour away, in Canada's busiest mall with parking a km away...

And it was a bargain for $20 when it retails for i think $79 from apple
    plus it increases resale value

I live in Australia and don't think I have a store near me?

I can't even speak to an Apple expert because I'm not in the US or Canada!

    What should I do?

    Btw I'm on 3.0 Jailbroken.
