Are New iPod Touches Delivered With OS3.0 Installed?

    I bought an iPod Touch 2G around three weeks ago with OS 2.2.1 installed. I immediately was informed that I could purchase OS 3.0 for $9.95. Since the new OS was available at the time I bought my iPod, shouldn't I be able to get the new OS for free? If not, when does Apple switch over to the newer OS installed in their iPods? I mean, I bought mine with 2.2.1 installed and it was, at one point, a paid upgrade. Did they wait until 3.0 came out before bumping up the OS to 2.x as standard in retail iPods?

    Also, why do iPhone users get the upgrade for free while iPod Touch users have to pay? The 32GB iPod Touch costs nearly $400 - which is more than a standard iPhone! I think either iPod owners should get a free upgrade, or iPhone users should have to pay as well. Let's even this out!

    No. They won't come with 3.0.

    Because the iPhone is a subsidized item. They pay monthly for their devices while you payed a one time fee.

    It's called the Sarbanes-Oxley Act.
    The SOx act states that you can't add more features to a one time charged (non-subscription service) without charging more money. The iPoT is a pay-once thing, the iPhone is a subscription. Thus, iPhone software is free, while iPoT software isn't.

    I believe that the pay-as-you-go European iPhones should have to pay for software updates, and Hacktivated / No SIM / No Contract / Phone Features Disabled (No Cellular connection) phone users should have to pay, too.

    iPhone users have to pay monthy contract, they deserve it to ne free.

    if your seriously complaining about it being 9.95 then dont get it, just get it the "illegal" way, and install it yourself ...

    I have iPhone and don't pay monthly, i use Pay and Go service.

    As to gershemer's comment I am a european PAYG customer and I do not have to pay for my updates. I pay money for credit. So they still get money from me.
