All they need to do is give the recipient the option to reject the gift so the refund is automatically credited once this has happened.

or just get rid of the 'gifting' process completely.

Letting the gifter know “XYZ has already purchased FunGame. Are you sure you want to proceed?” would be a privacy issue.

    This is true.
This is probably the ideal solution.

There are a few other things that bother me about it.

I bought Camera Plus Pro a few weeks ago. I love it. Anyway, I bought it to gift to a friend who lives in the US. He couldn't use it because the code is Canadian. So I gave it to someone else.

Apparently you can only gift apps to people in the same country.

One other thing that is a bummer, if you have iTunes credit, you can't gift apps with it. I don't see why not.

I am sure all of this simply boils down to trade laws, converting currency and so on tho. I don't really know alot about the whole process.

You can't say that from this. iCloud only stores the backups of your devices so there is nothing confusing. You get the apps you purchased on one of your devices not some your wife downloaded and you don't want. And, that's the most important bit, you can use iMessage.

    I am able to...

On a side note, if the person already has the app, then maybe allow the receiver the option to use that amount towards another app they want. Apple still gets their cut...
