Ok people, you need to stop freaking out! Apple would not brick you iPod through an update because if they did, they'd lose most of there most loyal users (most loyal users know more about the systems and most likely have jailbroken.) Also, Apple would get a bad reputation for this and it would just cause chaos because many people would be screwed. Also, why would they brick your ipod for updating? THEY WANT YOU TO UPDATE SO YOU WON'T DO IT AGAIN! DUH! people come on, use common sense!

However, they could change them stuff around to accommodate new changes, and accidentally screw up a couple iPods.

if they did screw up your pod, they'd probably be willing to replace it.

I bet you can count on one hand the percentage of people with jailbroken ipod touch and iPhones. I betcha $5.

Besides, why couldn't you just restore to a non-jailbroken version before updating?

That is about iPhones. They can only do this to iPhones, not iPod Touch owners. This is because jailbreaking an iPhone allows you to go with a different carrier and that violates their exclusivity with AT&T. They make profit from their contracts, and since an iPod does not have a contract with any companies, except for the hardware etc.

My cousin is a lawyer and she explained that sh'es gotten a lot of calls about this.

Well, to play devil's advocate, the iPod is a different case because Apple isn't any agreement with a cell-phone company with the iPod Touch. With the iPhone, it seems likely that AT&T might have nudged Apple to do something about these unlocked phones threatening their exclusivity with the iPhone. But it could have just been accident, which is a thing that could happen to the iPod Touch.
