I'm not sure if that would work since you bought it from a store other than apple. Its worth a try though

Well according to the specifications here, it has 1 year mfr. warranty, and im guessing that is apple.

Take it directly back to an Apple Store.
Explain the situation and they should offer to replace the faulty product on the spot.

I've gotten my iPhone replaced twice:

First one had cracks appear on back cover and they swapped it out for...

One which had major light leakage down the side of the screen, which they then swapped for my current one which...

had cracks appearing under the glass screen, the headphones (which got replaced the first time round) handsfree has died also.

Planning on going in after Xmas to swap for a new one again.

You can keep doing this for the entire year of your warranty.

    Hope this info helps.

The 1 year warranty clock starts ticking the first time the device is activated. It doesn't matter where you bought the iPod, the Apple Store will happily fix/replace it. My original 1G iPod Touch was bought in the US and sold to me via eBay.co.uk, I had no problems when the docking connector became faulty and Apple just replaced the device.

    You Could .

Just go to Apple.com , to support and you'll find your way there under iPod support you just type in the serial number and set things up there and Apple will send you a box you place your iPod in the box and order pickup for that box Apple will take care of the rest ( it's easy ) .

No. If they replace it for any reason, you will just get a refurbished 1G.

So when they replace it right on the spot at the store (I dont want to go through any hefty long RMA process), do they give me a whole new one in a box or just a refurb or something?
