Apple tracks JB iPhones?

    I just sold my 2G iPod Touch (2.2.1) and got an iPhone, I was going to JB it but then my friend said that Apple/AT&T can track 3G JB iPhones. Just wondering if this was true, as I was thinking about JBing it.

    it is possible, but illegal and probably not happening

    I thought it was just a breach of contract, not breaking any other laws...

    it is break of contract, but tracking someone, and what they have on their phone is definatly illegal

    My touch was JBen until I unjailbroke it to sell it.

    Even if this were possible, one that it's illegal and two only iPhones are affected, but as stated it is an illegal invasion of privacy.
