It really depends on the store. I took my little bro on my trip today and we stopped at an Apple Store. He wanted to get a new case and check out an issue with his 1g which is jailbroken. The guys at the store didn't care, they still helped him. Probably because all the employees have their 3gs jailbroken, even though they aren't supposed to. I wouldn't risk it though, you should probably restore it before you take it in there.

Why don't you just restore before you take it back?

If you take it back to get fixed jailbroken, they won't fix it because jailbreaking voids your warranty. But why not restore?

Jailbreaking DOES NOT void your warrenty! It's just frowned upon by Apple.

Unlocking your iPhone would cause it to be voided!

Doesn't really matter what we say or what research you do regarding warranty. If the reps at the Apple Store refuse to look at your jailbroken iPod/iPhone, no amount of complaining will change that.

And I have had my nephews iPod refused service because it was jailbroken. When I went back to speak to the rep, he told me that it did void the warrenty. I took him to another Apple store and they took care of him.
