I often get it and the only way to fix it is to restart iPod. Wondering if this is a problem with headphones, hardware or maybe firmware.

Exhonour, are you jailbroken and using Insomnia? If so I've got the same problem. I never have the problem unless I've been running Insomnia. What works for me is to shut Insomnia off, lock the iPod, wait about 20 seconds and unlock it. It should now work normally until you use Insomnia some more. That way you can avoid having to reboot your iPod. I don't know if it's a hardware or firmware problem but it never happened on my 1G or 2G.

I've had this on mine, seems to be if you play music through the speaker and the plug headphones in, fixed it with a reboot but that was before I used blackra1n

Had it happen once. Just paused music, unplugged headphones, plugged back in, hit play and all was fine.

EDIT: damn it actually now I'm having a problem again but now its my ipod speaker itself not working at all even when the headphones are unplugged

EDIT2: OK i think i fixed it because it all seems to be working correctly at the moment but it is possible that this will re occur idk but basically my recommendation is to completely remove insomnia if there's too many issues with it like what i had, that's what i did anyway which sucked because that feature was really useful to me.
