I got to go to the Apple Store tonight to get a new 3G touch or mine fixed because my power button is stuck. Just a few quick questions.

Does it matter that I don't have the receipt?

If they can't fix it, do I get a new one or a refurbed one?

and If the new one comes with 3.1.3, I can't jb or downgrade it right?

Well at the most you should at least restore it and as long as its under warranty i dont believe you need the receipt. If they cant fix it and its still under warranty you get a shiny new one. That may be how it is any way.

They (and you) can check the serial number to see if it's still under warranty so there's no need for the receipt. If it's not under warranty you'll have to pay to get it fixed.
