I have 3.1.2 on my 2nd gen Itouch and its jailbroken. I haven't upgraded to 3.1.3 since it didnt really provide anything useful. When I open itunes it only asks me whether I want to update to 3.1.3 not 4.0. Do I have to update to 3.1.3 before I update to 4.0?

I would like to go from 3.1.2 directly to 4.0

no you don't have to update to 3.1.3 first, but I would restore it before you upgrade.

Same situation just click restore and it will say restore and update, and it will update you to ios4.

I would back up your iPod via iTunes and then DFU restore it. That'll give you the latest firmware (4.0, of course). When you set up your iPod, just put the backup you created onto it and you'll have everything you had before.

You should be able to go directly to 4.0, skipping the 3.1.3 install.
