Apple and Samsung have been dueling it out in court over a patent dispute between the iPad and Galaxy Tab, and one of Apple’s primary legal defenses is how strikingly similar Samsung’s tablet looks compared to the iPad. While Samsung denies blatantly copying Apple’s designs, even their lawyers can’t tell the difference between the two devices. When Judge Koh held both tablets over her head in court and asked both of Samsung’s lawyers to identify which was which at a distance of 10 feet, neither could immediately tell the difference.
Koh frequently remarked on the similarity between each company’s tablets. At one point during the hearing, she held one black glass tablet in each hand above her head, and asked Sullivan if she could identify which company produced which.
“Not at this distance your honor,” said Sullivan, who stood at a podium roughly ten feet away.
“Can any of Samsung’s lawyers tell me which one is Samsung and which one is Apple?” Koh asked. A moment later, one of the lawyers supplied the right answer.
